Walmart agreed to a $1.85 million class action settlement to resolve claims that its check processing disclosures failed to adequately inform customers about potential multiple bank fees for insufficient funds. The lawsuit, Morris v. Walmart Inc., et al., alleged that Walmart and its check processor TeleCheck did not sufficiently disclose that they might make multiple attempts to cash bounced checks and, if successful, might also make multiple attempts to recover "return fees" from shoppers' bank accounts.
Customers were allegedly damaged when they incurred multiple bank fees as a result of Walmart and TeleCheck repeatedly attempting to collect the underlying check amount and the return fee. TeleCheck is a check verification and guarantee company that works with retailers like Walmart to process customer checks.
While Walmart has not admitted any wrongdoing, the company agreed to pay $1.85 million to cover attorneys' fees and settlement administration costs, and to implement meaningful changes to its check-processing disclosure practices at stores nationwide.
This settlement does not provide direct monetary relief to class members. Instead, Walmart has agreed to change its check-processing disclosures at the point of sale and on the PIN pad in each of its retail stores across the United States. These updated disclosures will better inform customers about the possibility of multiple attempts to process bounced checks and recover return fees, helping shoppers avoid unexpected bank charges in the future. The $1.85 million settlement fund covers attorneys' fees, litigation costs, and settlement administration expenses.
