Popular Bank has agreed to pay $1.5 million to settle a class action lawsuit that alleges the bank improperly charged overdraft fees on certain debit card and ATM transactions.
The lawsuit claims that Popular Bank breached its account agreements by imposing overdraft fees on transactions referred to as Authorize Positive, Settle Negative Transactions (APSN). According to the complaint, these fees were applied when a transaction that was initially authorized with sufficient available funds later overdrew the account when it cleared.
Key Settlement Benefits:
- Class members will receive a pro rata share of the settlement fund based on the overdraft fees they paid during the class periods.
- Current Popular Bank account holders will receive their compensation as an account credit.
- Former account holders will receive their payment as a check.
No action is required to receive benefits. Class members who do not opt out by the exclusion deadline will automatically receive payments.
Popular Bank, a provider of personal and business banking services, has not admitted any wrongdoing but agreed to resolve these claims with this settlement. Payment estimates are not yet available. If you were charged overdraft fees by Popular Bank during the eligible periods, you may receive compensation as part of this settlement.
