Popular Bank has agreed to pay $1.5 million to settle a class action lawsuit that alleges the bank improperly charged overdraft fees on certain debit card and ATM transactions.
The lawsuit claims that Popular Bank breached its account agreements by imposing overdraft fees on transactions referred to as Authorize Positive, Settle Negative Transactions (APSN). According to the complaint, these fees were applied when a transaction that was initially authorized with sufficient available funds later overdrew the account when it cleared.

No action is required to receive benefits. Class members who do not opt out by the exclusion deadline will automatically receive payments.
Popular Bank, a provider of personal and business banking services, has not admitted any wrongdoing but agreed to resolve these claims with this settlement. Payment estimates are not yet available.
