The plaintiffs in the Panera delivery fees class action lawsuit claimed they encountered unexpected charges when ordering delivery from Panera, asserting that the restaurant misled customers regarding both delivery fees and menu prices.
According to the lawsuit filed last year in Illinois, Panera purportedly advertised free or low-cost deliveries, typically with a $1 or flat rate, for orders placed through their mobile app or website. However, customers alleged that Panera then added hidden fees, contradicting the initial promises.
The lawsuit specifically alleged that Panera inflated food prices for delivery orders by 5% to 7%. For instance, ordering a sandwich through the mobile app might result in an additional $1 delivery charge compared to in-store pickup, as stated in the lawsuit.
Importantly, this extra fee allegedly appeared only after customers selected delivery or pickup on the app or website.
As part of the settlement terms, affected customers have the option to receive vouchers or an electronic cash payment.
Panera opted to settle the case without admitting any wrongdoing.
