The class action lawsuit alleges that Infinity Healthcare violated Wisconsin law by imposing disproportionately high fees for the retrieval and certification of patient health records. Plaintiffs argue that these fees, which encompass basic, retrieval, processing, and certification charges, resulted in financial harm to them.
While Infinity Healthcare has not admitted to any wrongdoing, it has agreed to a $2 million settlement to resolve the lawsuit. Under the terms of the settlement, eligible class members stand to receive compensation of up to four times the amount they were charged in fees. However, payments will be adjusted proportionately if the total claims surpass the settlement fund.
This settlement applies to Infinity Healthcare patients in Wisconsin who requested their health care records and were subjected to fees exceeding $1 per page since April 18, 2013.
