Current and former Equity Bank accountholders charged APSN overdraft fees, retry fees, or sufficient funds overdraft fees during the applicable class periods between January 1, 2017, and November 21, 2025, are eligible.

A class action lawsuit alleged that Equity Bank improperly assessed overdraft and nonsufficient funds fees against accountholders in alleged violation of its account agreements and applicable law. The challenged fees allegedly included charges on debit card transactions authorized on a sufficient balance, fees on second or third presentments of the same item, and overdraft fees charged when the end-of-day balance was not overdrawn. Equity Bank denies any wrongdoing but has agreed to a $1 million settlement to avoid the expense and uncertainty of ongoing litigation.
Eligible class members may receive a pro rata payment based on the amount of challenged fees they were charged. Payments may be issued by check, applied as an account credit, or provided as forgiveness of unpaid challenged fees. Individual payment amounts will vary depending on each claimant's share of the total challenged fees paid relative to all other eligible class members.
