$1M Equity Bank Overdraft Fees Settlement

Current and former Equity Bank accountholders charged APSN overdraft fees, retry fees, or sufficient funds overdraft fees during the applicable class periods between January 1, 2017, and November 21, 2025, are eligible.

About This Settlement

A class action lawsuit alleged that Equity Bank improperly assessed overdraft and nonsufficient funds fees against accountholders in alleged violation of its account agreements and applicable law. Who Qualifies

• You may be eligible for this settlement if you meet the following criteria:
• You are a current or former Equity Bank accountholder
• You were charged one or more of the following 'challenged fees':
• • APSN fees (fees on debit card transactions authorized on a sufficient available balance) charged between Jan. 1, 2017–Dec. 7, 2019, or between Nov. 8, 2020–Sept. 1, 2024
• • Retry fees (fees on the second or third presentment of the same item) charged between Feb. 22, 2018–Dec. 31, 2023
• • Sufficient funds fees (overdraft fees charged when the end-of-day balance was not overdrawn) charged between Feb. 2, 2017–Nov. 21, 2025
• No proof of purchase is required
• This settlement is open to eligible accountholders nationwide

What You May Receive

Eligible class members may receive a pro rata payment based on the amount of challenged fees they were charged. Payments may be issued by check, applied as an account credit, or provided as forgiveness of unpaid challenged fees. Individual payment amounts will vary depending on each claimant's share of the total challenged fees paid relative to all other eligible class members.
