Cincinnati Insurance has reached a settlement in a class action lawsuit alleging that the company improperly deducted depreciation from actual cash value payments for residential and commercial property insurance claims.
The lawsuit, filed by Belle Meade Owners Association, Inc., a Tennessee corporation, claimed that Cincinnati Insurance unfairly deducted depreciation on labor costs and general contractor overhead and profit when calculating insurance payouts in several states.
The settlement benefits policyholders who experienced covered structural losses in Arizona, California, Illinois, Kentucky, Missouri, Ohio, Tennessee, Texas, Vermont, Virginia, Washington, or Wisconsin between April 8, 2012, and May 31, 2022. The exact class period varies depending on the state and whether the claimants are policyholders or non-policyholders.
Under the terms of the settlement, eligible class members may receive up to 100% of the non-material depreciation withheld from their original actual cash value payments, along with 5% simple interest on this reimbursement. While Cincinnati Insurance denies any wrongdoing, they have agreed to the settlement to resolve the class action lawsuit.
