FCTI has agreed to a $10 million settlement to resolve claims that it charged excessive ATM fees at 7-Eleven locations. The settlement benefits two classes of individuals: a New York class and a nationwide class, covering those who were charged more than one ATM fee for a balance inquiry during a single visit between May 1, 2018, and November 16, 2021.
In the class action lawsuit, plaintiffs alleged that FCTI, an ATM provider operating in 7-Eleven stores, charged double out-of-network fees for single balance inquiry transactions. They claim that these fees were the result of FCTI’s system improperly transmitting two balance inquiry requests to consumer banks, resulting in excessive charges. FCTI denies any wrongdoing but agreed to the $10 million settlement to resolve the claims.
The settlement provides different benefits for each class:
To receive settlement benefits, eligible class members must submit a valid claim form by October 22, 2024. No proof of purchase is required to file a claim.
