Saks Off 5th has agreed to a settlement resolving claims that it deceptively marketed false discounts to consumers.
The class action lawsuit alleges that Saks Off 5th marked up its prices before discounting them, misleading customers into believing they were receiving significant savings. Plaintiffs claim this pricing strategy violated California’s false advertising and consumer protection laws, which prohibit retailers from inflating original prices to create illusory discounts.
The lawsuit claims that:
- Saks Off 5th misrepresented sale prices to persuade customers to buy.
- Price tags showed markdowns from inflated "original prices" that were never the true retail price.
- The retailer failed to provide transparency about actual savings.
Saks Off 5th denies all allegations but has agreed to provide $1.5 million in merchandise certificates to settle the lawsuit.
Under the Terms of the Settlement
- Class members can receive a merchandise certificate worth up to $20.
- If the total value of certificates claimed by Tier 2 class members exceeds $1.5 million, the value of the certificates will be reduced proportionally. Certificates for Tier 1 class members will not be reduced.
- Certificates do not expire and are transferable, but cannot be redeemed for cash, used for gift cards or services, or combined with other settlement certificates.
- Tier 1 class members will automatically receive a merchandise certificate without submitting a claim form.
- Tier 2 class members must submit a valid claim form to receive a certificate.
This settlement compensates affected consumers while also holding Saks Off 5th accountable for its alleged misleading sales tactics.
