MAM Baby Products Settlement: $2.75M

U.S. residents who purchased eligible MAM baby products for personal use (not resale) between March 17, 2016, and September 30, 2024.

Not required for smaller claims; documentation required for larger claims and refunds.

MAM USA Corporation, a popular baby product manufacturer, has agreed to a $2.75 million settlement in a class action lawsuit alleging misleading advertising of certain products, including pacifiers and bottles.

Plaintiffs argue that MAM Baby falsely marketed its products as "orthodontic," claiming they “promote proper oral development” or are “orthodontically correct,” without sufficient scientific backing. This, plaintiffs claim, violated various consumer protection laws, including breach of warranty and unjust enrichment.

MAM USA denies these allegations but has agreed to settle the claims.

The lawsuit covers various MAM pacifiers and products, purchased between 2016 and 2024, including:

• Air Pacifiers

  • 2-pack (all sizes) purchased March 17, 2016 – September 30, 2024
  • Day & Night 3-pack (all sizes) purchased February 2022 – September 30, 2024
  • Night 2-pack (size 6+) purchased March 17, 2016 – January 2020 or February 2022 – September 30, 2024
  • Night 2-pack (size 16+) purchased March 17, 2016 – April 2020 or February 2022 – September 30, 2024

• Comfort Pacifiers

  • 2-pack (size Newborn or 0-6) purchased January 2021 – September 30, 2024

• Original Pacifiers

  • 1-pack (size Newborn or 6+) purchased March 17, 2016 – September 30, 2024
  • 2-pack (sizes Newborn, 0-6, 6+, 16+) purchased March 17, 2016 – September 30, 2024 (varies by size and purchase dates)
  • 3-pack (sizes Newborn, 0-6, 6+) purchased March 17, 2016 – September 30, 2024 (varies by size and purchase dates)
  • Day & Night 3-pack (sizes 0-6, 6+, 16+) with varying purchase dates

• Original Night Pacifiers

  • 2-pack (sizes 0-6, 6+) with varying purchase dates

• Original Pure Pacifiers

  • 2-pack (all sizes) purchased February 2023 – September 30, 2024

Under the settlement terms, eligible class members can select from the following compensation options:

1. Without Proof of Purchase:
   • Up to $1.50 in cash (limited to three products per household) or
   • A $6 product voucher for MAM products.
     
     
2. With Proof of Purchase:
   • Up to $20 in cash for documented purchases or
   • A $30 voucher for documented purchases.

The settlement also includes an agreement by MAM USA to discontinue "orthodontic" labeling on its products. Product vouchers are redeemable on the MAM website, are transferable, and are valid for 18 months from issuance.
