Hino Motors, a manufacturer of medium-duty trucks owned by Toyota, has agreed to a $237.5 million settlement to resolve a class action lawsuit alleging that certain Hino truck models emitted significantly more pollutants than allowed by regulations.
The lawsuit claimed that Hino trucks achieved lower fuel economy in real-world driving conditions than during laboratory testing conducted to comply with emissions regulations. This resulted in higher emissions of nitrogen oxides (NOx), a group of pollutants that contribute to smog and acid rain. Plaintiffs alleged that Hino knew about this discrepancy but failed to disclose it to consumers or regulatory bodies.
Specifically, the lawsuit alleged:
While Hino has not admitted any wrongdoing, they have agreed to the settlement to avoid the costs and risks of further litigation. The settlement provides compensation to owners and lessees of certain Hino truck models (see list above) who held ownership or a lease as of October 30, 2023.
Eligible class members can receive between $1,500 and $15,000 per truck, with the exact amount depending on the total number of claims filed.
