OneTouchPoint (OTP), a marketing and communications company serving healthcare, education, and finance industries, allegedly failed to implement reasonable cybersecurity measures, resulting in a data breach in April 2022 that is estimated to have compromised the sensitive personal information of more than 2.65 million individuals. Plaintiffs alleged that OTP's failure to take adequate security precautions violated its legal duties to its customers and their patients. Eligible class members may receive one of the following forms of compensation: up to $500 for ordinary losses (such as bank fees, communication charges, data fees, or credit expenses) supported by documentation; up to $5,000 for extraordinary losses (such as identity theft, fraud, or professional fees) supported by documentation; up to $100 for lost time, calculated at an estimated $25 per hour for up to four hours; or a flat $75 cash payment with no documentation required. Additionally, all class members may be eligible to receive two years of free credit monitoring that includes at least $1 million in fraud protection coverage. Actual payout amounts are not guaranteed and may vary based on the number of valid claims submitted and available settlement funds.
