Who's eligible?

All natural persons in the United States for whom a prescription for NP Thyroid® was dispensed between May 12, 2018, and April 30, 2021, whether or not Acella recalled the NP Thyroid®

Proof of Purchase

Yes, proof is required.

To receive payment, you need to provide proof of receiving a prescription for NP Thyroid® between May 12, 2018, and April 30, 2021.

Acceptable proof includes an original or copy of a pharmacy receipt, pharmacy records, or insurance records showing the prescription was filled during that period.

If you want more than the $10 minimum payment, your documentation must show how much you paid out of pocket.

If you've already received a refund from Acella for purchases related to the recalls in May 2020, September 2020, or April 2021, or if you've requested a refund through another program for any purchases during the class period, you're not eligible for payment under this class action settlement.

A federal judge has granted preliminary approval to a class action settlement resolving the dispute between Acella Pharmaceuticals LLC and patients who claimed they were overcharged for a thyroid medication because of incorrect levels of active ingredients.

The settlement aims to address the grievances raised by the plaintiffs, who argued that Acella knowingly marketed ineffective NP Thyroid®. They contended that Acella misrepresented the product's compliance with USP monograph specifications by labeling it as "Thyroid Tablets, USP" on bottle labels and in marketing materials.

Additionally, plaintiffs pointed to testing data indicating widespread inconsistencies in the levels of active ingredients across multiple batches of NP Thyroid® manufactured between May 12, 2018, and April 30, 2021. The company voluntarily recalled the thyroid medication on April 29, 2021, after testing revealed low potency in 35 batches.
