Mylan Pharmaceuticals has agreed to a $73.5 million class action settlement to resolve allegations that it worked with Pfizer and Teva to suppress competition from lower-cost generic EpiPen products. According to the lawsuit, this conspiracy allowed Mylan and its co-defendants to maintain a monopoly over the market and continue charging elevated prices, harming entities that purchased directly from them.
The plaintiffs claim that Mylan and Teva entered into a pay-for-delay scheme, holding off generic EpiPen competition that would have otherwise lowered prices. As a result, those who purchased the products directly from the manufacturers during the class period may have overpaid due to the lack of generic alternatives.
Mylan denies all claims but agreed to the $73.5 million settlement to avoid further litigation. The case involves direct purchasers only—entities such as wholesalers, pharmacies, or large healthcare providers that bought directly from Mylan or Teva.
Eligible class members may receive a payout based on the volume of qualifying purchases of branded or generic EpiPen products made between March 13, 2014, and February 6, 2025. Reimbursement amounts will be calculated proportionally, and specific payment estimates are not available yet. Entities must submit valid proof of purchase with their claim.
