Pfizer Effexor XR Antitrust Settlement: $25.5M

You may be eligible for a settlement benefit if you meet all the following criteria:

• Purchased Effexor XR or an AB-rated generic version of Effexor XR (a generic deemed to be therapeutically equivalent) in one of the 21 listed states.
  
  
• Paid for, or were reimbursed for, some or all of the cost of the medication.
  
  
• Purchased the medication between June 14, 2008, and May 31, 2011.

To receive a settlement payment, you will need to submit proof of your purchase(s) of Effexor XR or a generic equivalent during the claim period in one of the listed states. Acceptable forms of proof include:

• Pharmacy or insurance records showing Effexor XR or generic purchases.
• Doctor's note or prescription records for Effexor XR or generics.
• Explanation of Benefits (EOB) from your health plan detailing Effexor XR or generic transactions.
• Receipts, checkbook entries, or credit card statements documenting Effexor XR or generic purchases.

Pfizer Inc. has agreed to pay $25.5 million to settle claims that its predecessor, Wyeth, conspired with Teva Pharmaceuticals to delay the release of generic versions of the antidepressant Effexor XR. This settlement follows a separate $39 million settlement for similar claims resolved earlier in May 2024.

The lawsuit alleged these anticompetitive practices kept the price of Effexor XR artificially high, harming consumers and insurers (indirect purchasers) who bought the drug between June 14, 2008, and May 31, 2011, in Arizona, California, Florida, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nevada, New Hampshire, New Mexico, New York, North Carolina, Oregon, Rhode Island, South Dakota, Tennessee, West Virginia, and Wisconsin.

While Pfizer denies any wrongdoing, they agreed to the settlement to resolve the lawsuit. The amount each eligible person receives will depend on the total number of claims filed and the amount of Effexor XR or generic equivalent they purchased.
