Pfizer Inc. has agreed to pay $25.5 million to settle claims that its predecessor, Wyeth, conspired with Teva Pharmaceuticals to delay the release of generic versions of the antidepressant Effexor XR. This settlement follows a separate $39 million settlement for similar claims resolved earlier in May 2024.
The lawsuit alleged these anticompetitive practices kept the price of Effexor XR artificially high, harming consumers and insurers (indirect purchasers) who bought the drug between June 14, 2008, and May 31, 2011, in Arizona, California, Florida, Kansas, Maine, Massachusetts, Michigan, Minnesota, Mississippi, Montana, Nevada, New Hampshire, New Mexico, New York, North Carolina, Oregon, Rhode Island, South Dakota, Tennessee, West Virginia, and Wisconsin.
While Pfizer denies any wrongdoing, they agreed to the settlement to resolve the lawsuit. The amount each eligible person receives will depend on the total number of claims filed and the amount of Effexor XR or generic equivalent they purchased.
