Real Good Foods, a popular low-carb frozen food company, has agreed to a settlement of $1.25 million to resolve a class action lawsuit alleging violations of the Telephone Consumer Protection Act (TCPA). The lawsuit centered on claims that Real Good Foods sent unsolicited text messages to consumers, even after they requested to opt-out of receiving them.
The TCPA prohibits companies from sending unsolicited telemarketing text messages, also known as spam texts. Plaintiff Jaclyn Cassidy alleged that she requested to stop receiving text messages from Real Good Foods on April 15, 2022, but the company continued to send her marketing texts until July 9, 2023. The lawsuit argued that these messages violated the TCPA.
Real Good Foods denies any wrongdoing but agreed to the settlement to avoid the costs and uncertainties of court proceedings.
The total settlement fund is $1.25 million. Eligible Class members who submit a timely claim form can choose to receive either a cash payment of up to $8.25 per class member or a $25 voucher to use on Real Good Foods products.
