Consumers stand to benefit from a $4.9 million settlement with Verisma Systems, aimed at resolving allegations of excessive fees charged for medical records. The settlement covers individuals or entities who requested their own or someone else's medical records and paid certification or retrieval fees to Verisma Systems after July 1, 2011.
Plaintiffs in the class action lawsuit asserted that Verisma Systems violated Wisconsin laws by charging excessive fees on behalf of various medical providers, including Froedtert Memorial Lutheran Hospital, St. Joseph’s Community Hospital of West Bend, and Community Memorial Hospital of Menomonee Falls, among others.
Verisma Systems, a medical solutions company offering services such as release of information and care coordination, has not admitted wrongdoing but agreed to the settlement terms.
Under the settlement, class members can receive a cash payment based on the fees paid and the invoice dates. For invoices dated between July 1, 2011, and Nov. 30, 2015, class members may receive 4.5 times the fees paid. For invoices dated between Dec. 1, 2015, and May 3, 2017, the reimbursement will be equal to the fees paid. For invoices dated on or after May 4, 2017, class members may receive 6.25 times the fees paid.
To be eligible for reimbursement, individuals must have requested medical records, paid Verisma Systems' fees, and not received reimbursement for those fees previously. Valid claims will be reimbursed according to the specified multipliers based on the invoice dates.
