Capital One is settling a class action lawsuit for $16 million over allegedly unfair fees on bounced checks and ACH transactions. Current and former account holders charged a "representment fee" between September 1, 2015 and January 12, 2022, may be eligible for a payout. This fee refers to an NSF or overdraft charge Capital One assessed after already bouncing a check or ACH debit for insufficient funds and also charging a fee on a previous attempt.
The lawsuit argued these fees violated Capital One's account agreements by not being refunded when the checks or ACH transactions were presented for payment again. While Capital One admits no wrongdoing, they agreed to the class action settlement.
Each class member will receive a share of the $16 million based on the number of these fees they were charged. Current account holders will get a credit, while former ones will receive a mailed check. There's no need to file a claim – those who don't opt out will automatically get a payment.
